Medical Consent & Patient Bill of Rights

By using the ClearedRx platform to seek medical care, you are entering into a relationship with an independent, licensed healthcare provider ("Provider") affiliated with our partner medical groups. This document outlines your consent to receive telehealth services and your rights as a patient.
Part 1: Informed Consent for Telehealth Services
1. Definition of Telehealth
Telehealth involves the delivery of healthcare services using electronic communications, information technology, or other means between a licensed healthcare provider and a patient who are not in the same physical location. This may include asynchronous communication (secure text messaging, medical questionnaires, sharing photos or lab results) and synchronous communication (live video or audio calls).
2. Expected Benefits
The primary benefits of telehealth include:
- Improved and easier access to medical care and specialists.
- Convenience of receiving care from your home without travel.
- More efficient medical evaluation and management.
3. Possible Risks
While telehealth is a safe and effective way to receive care for many conditions, there are potential risks, including but not limited to:
- Information Limitations: The information transmitted may not be sufficient (e.g., poor resolution of images) to allow for appropriate medical decision making by the Provider.
- Lack of Physical Exam: The inability to conduct a hands-on physical examination could lead to a missed diagnosis or an inappropriate treatment plan.
- Technical Failures: Delays in medical evaluation and treatment could occur due to deficiencies or failures of the equipment or internet connection.
- Security Breaches: Although we use highly secure, HIPAA-compliant encryption, in rare instances, security protocols could fail, causing a breach of privacy of personal medical information.
4. Patient Responsibilities
By consenting to telehealth services, you agree to:
- Provide accurate, complete, and truthful information about your medical history, current symptoms, and any medications or supplements you are taking.
- Follow the treatment plan and instructions provided by your Provider.
- Inform your primary care physician about any medications prescribed through ClearedRx.
- Seek immediate emergency medical care (call 911 or go to an ER) if you experience a medical emergency. Telehealth is not for emergencies.
5. Alternatives to Telehealth
The alternative to receiving care via telehealth is to visit a primary care provider or specialist in person. You always have the right to choose in-person care instead of using the ClearedRx platform.
6. Information Sharing and Medical Records
You have the right to access your medical records created through your use of ClearedRx. With your consent, we can share these records with your primary care provider or other healthcare professionals to ensure continuity of care.
7. Right to Withdraw Consent
You have the right to withdraw your consent to the use of telehealth in the course of your care at any time, without affecting your right to future care or treatment. To withdraw consent, please contact support@clearedrx.com.
Part 2: Patient Bill of Rights
As a patient receiving care through the ClearedRx platform, you have the right to:
- Respect and Non-Discrimination: Be treated with dignity, respect, and consideration, regardless of race, religion, gender, sexual orientation, national origin, age, or disability.
- Information and Transparency: Receive clear, understandable information about your diagnosis, proposed treatments, alternatives, risks, and expected outcomes.
- Privacy and Confidentiality: Have your medical records and personal health information kept confidential, in accordance with HIPAA and applicable state laws.
- Choice and Refusal: Have the freedom to choose your pharmacy for prescription fulfillment. You also have the right to refuse any recommended treatment or medication.
- Grievances: File a complaint or grievance regarding your care or the services provided without fear of retaliation or discrimination. You may contact us at support@clearedrx.com to file a grievance.
Part 3: State-Specific Disclosures
Depending on the state in which you reside, the following additional disclosures may apply to your care:
- California: Medical doctors are licensed and regulated by the Medical Board of California. To check up on a license or to file a complaint go to www.mbc.ca.gov, email: licensecheck@mbc.ca.gov, or call (800) 633-2322.
