Important Distinction: ClearedRx operates a technology platform that connects you with independent, affiliated medical providers and pharmacies. ClearedRx itself does not provide medical advice or care. While ClearedRx is not a "Covered Entity" under the Health Insurance Portability and Accountability Act (HIPAA), the affiliated medical providers are Covered Entities. ClearedRx acts as a "Business Associate" to these providers and protects your Protected Health Information (PHI) in accordance with HIPAA regulations and our Business Associate Agreements.

1. Information We Collect

Personal Information

We may collect personally identifiable information that you voluntarily provide to us when you create an account, complete a quiz, or contact support. This includes:

  • Marketing & Advertising: With your consent, to send you promotional emails, SMS text messages, and newsletters about new products or offers. We also use browsing data to deliver relevant advertisements on third-party platforms.

  • Legal & Compliance: To comply with applicable laws, enforce our Terms of Service, prevent fraud, and protect the rights and safety of ClearedRx, our users, and the public.

3. SMS/Text Messaging and TCPA Compliance

By providing your mobile phone number and opting in, you consent to receive SMS text messages from ClearedRx. This includes:

  • Transactional Messages: Account updates, prescription status, shipping notifications, and provider messages.

Consent is not a condition of purchase. Message and data rates may apply. You may opt out of receiving marketing text messages at any time by replying "STOP" to any message you receive from us. After texting "STOP," you may receive one final confirmation message. Opting out of marketing messages will not stop transactional messages necessary for your care.

We do not share or sell your mobile number or SMS opt-in consent data to third parties for their own marketing purposes.

  • With Healthcare Providers & Pharmacies: We share your PHI with affiliated medical groups and partner pharmacies strictly to facilitate your consultation, diagnosis, and prescription fulfillment.
  • With Service Providers: We share data with trusted third-party vendors who perform services on our behalf (e.g., Stripe for payment processing, AWS for secure hosting, shipping carriers, email/SMS delivery platforms). These vendors are bound by confidentiality agreements and, where applicable, Business Associate Agreements.
  • For Legal Reasons: We may disclose information if required by law, subpoena, or court order, or if we believe disclosure is necessary to protect public safety, investigate fraud, or enforce our agreements.
  • Business Transfers: In the event of a merger, acquisition, reorganization, or sale of assets, user information may be transferred as part of the transaction. You will be notified via email or a prominent notice on our website of any such change in ownership.

Marketing Opt-Out

We retain your personal information and PHI for as long as your account is active, or as required by applicable federal and state medical record retention laws (typically 7-10 years).

7. Children's Privacy

Our platform and services are intended exclusively for individuals who are 18 years of age or older. We do not knowingly collect personal information or provide services to minors. If we discover that a minor has provided us with personal information, we will promptly delete the account and the associated data.

8. Do Not Track Signals

Some web browsers incorporate a "Do Not Track" (DNT) feature. At this time, our website does not respond to DNT signals, as there is no uniform industry standard for recognizing and implementing DNT signals.
