PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A MANDATORY BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES.

Welcome to ClearedRx. These Terms of Service ("Terms") govern your access to and use of the ClearedRx website (clearedrx.com) and the technology platform, products, and services provided by Blue Bench Media LLC d/b/a ClearedRx ("ClearedRx," "we," "us," or "our").

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the platform.

1. Nature of Services: We Are Not a Medical Provider

ClearedRx operates a technology platform that connects users with independent, licensed healthcare providers and partner pharmacies. ClearedRx itself is not a healthcare provider, pharmacy, or medical group. We do not provide medical advice, diagnosis, or treatment. Any medical care, advice, or prescriptions you receive are provided exclusively by the independent medical practitioners who utilize our platform.

NOT FOR EMERGENCIES: The ClearedRx platform is not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

2. Eligibility and Availability

To use our services, you must:

  • Be at least 18 years of age.
  • Be a resident of the United States.
  • Be physically located in a state where our affiliated medical providers are licensed and operate.
  • Provide accurate, current, and complete information during registration and medical intake.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we believe you violate these eligibility requirements.

3. Prescription Policy

There is no guarantee that a medical provider will write you a prescription. The decision to prescribe medication is made solely by the independent medical provider based on their clinical judgment and your specific health needs.

  • No Controlled Substances: Our affiliated providers do not prescribe DEA-controlled substances (such as narcotics or certain anti-anxiety medications).
  • Pharmacy Choice: While ClearedRx partners with specific mail-order pharmacies for convenient fulfillment and delivery, you have the right to request that your prescription be sent to a local pharmacy of your choice. If you choose an outside pharmacy, you will be responsible for paying them directly, and ClearedRx's subscription pricing will not apply.

4. Subscriptions, Billing, and Payments

Many of our services and products are offered on an auto-renewing subscription basis.

  • Auto-Renewal: By signing up for a subscription, you authorize us to automatically charge your payment method on file on a recurring basis (e.g., monthly or quarterly) until you cancel.
  • Cancellation: You may cancel your subscription at any time through your account portal or by contacting support. To avoid being charged for the next billing cycle, you must cancel at least 48 hours before your next scheduled processing date.
  • Cash-Pay Only: ClearedRx services are cash-pay. We do not accept or bill health insurance, Medicare, or Medicaid. You are solely responsible for the cost of all services and products.

5. Communications Consent (TCPA & CAN-SPAM)

By creating an account and providing your contact information, you consent to receive electronic communications from ClearedRx, including emails, SMS text messages, and phone calls.

  • Transactional Messages: You agree to receive messages regarding your account, orders, and medical care. These are necessary for the provision of services.
  • Marketing Messages: If you opt-in, you agree to receive promotional messages and offers. You can opt out of marketing emails by clicking "unsubscribe" and out of marketing SMS by replying "STOP".
  • Data Rates: Standard message and data rates may apply to SMS communications. Consent to receive marketing texts is not a condition of purchasing any goods or services.

6. Intellectual Property

All content on the ClearedRx website, including text, graphics, logos, images, software, and design, is the property of ClearedRx or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without explicit written permission.

7. Disclaimer of Warranties

THE CLEAREDRX PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAREDRX, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES.

IN NO EVENT SHALL CLEAREDRX'S AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO CLEAREDRX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE THOUSAND DOLLARS ($1,000), WHICHEVER IS GREATER.

9. Dispute Resolution: Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

  • Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved by binding, individual arbitration, rather than in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
  • Class Action Waiver: YOU AND CLEAREDRX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.
  • Governing Law: These Terms and any disputes will be governed by the laws of the State of Wyoming, without regard to its conflict of law principles.

10. Changes to Terms

We may modify these Terms at any time. We will post the revised Terms on this page and update the "Last updated" date. Your continued use of the platform after any changes indicates your acceptance of the new Terms.
